PROPERTY LISTING AGREEMENT

Soccer Housing Bureau Website Listing

This Property Listing Agreement (this “Agreement“) is entered into between:

HOMEOWNER (referred to herein as “Homeowner“)
AND
SOCCER HOUSING BUREAU, LLC, a Georgia limited liability company (referred to herein as “SHB“).

RECITALS

WHEREAS, Homeowner is the owner of real property suitable for short-term rental during the Event; and

WHEREAS, SHB operates the Platform to enable homeowners to publish, offer, and market properties to prospective short-term renters seeking accommodations during the Event; and

WHEREAS, Homeowner desires to list the Property on the Platform, and SHB agrees to provide listing services under the terms and conditions set forth herein.

NOW, THEREFORE, in consideration of the mutual covenants and agreements contained herein, the parties agree as follows:

ARTICLE II: PLATFORM ROLE AND RELATIONSHIP

Section 2.01 Platform Provider Only


THE PLATFORM ENABLES HOMEOWNERS TO PUBLISH, OFFER, AND MARKET PROPERTIES TO PROSPECTIVE THIRD-PARTY RENTERS.
SHB DOES NOT OWN, CONTROL, OFFER, OR MANAGE ANY PROPERTIES OR RENTAL SERVICES.
SHB IS NOT A PARTY TO CONTRACTS BETWEEN HOMEOWNERS AND THIRD-PARTY RENTERS.

Section 2.02 What SHB Is Not

  • A real estate broker, agent, or salesperson
  • A property manager or management company
  • An insurer or provider of insurance
  • A travel agency or tour operator
  • A party to any Renter Agreement
  • An employer, agent, joint venturer, or partner of Homeowner
  • A guarantor of any Third-Party Renter’s performance or payment
  • A provider of legal, tax, financial, or other professional advice

Section 2.03 No Agency or Fiduciary Relationship

SHB acts solely as a facilitator and technology platform provider. Nothing in this Agreement creates any agency,
fiduciary, joint venture, partnership, or employment relationship between SHB and Homeowner.

Section 2.04 Direct Contracts

Renter Agreements are formed directly between Homeowner and Third-Party Renters. SHB is not a party to such contracts.

ARTICLE III: TERM AND TERMINATION

Section 3.01 Term

This Agreement shall commence on the Effective Date and continue through August 31, 2026.

Section 3.02 Termination

Either party may terminate this Agreement upon thirty (30) days’ written notice.
SHB may terminate immediately for breach or legal violations.

Section 3.03 Effect of Termination

Protective provisions, including indemnification, limitation of liability, and arbitration, shall survive termination indefinitely.

ARTICLE IV: SHB SERVICES AND LIMITATIONS

Section 4.01 Platform Services

  • Maintain property listings
  • Market listings to Event attendees
  • Facilitate communication
  • Provide standardized Renter Agreement templates
  • Provide guest inquiry contact information

Section 4.02 No Screening or Guarantees


SHB DOES NOT SCREEN, VERIFY, GUARANTEE, OR SUPERVISE RENTERS, PROPERTIES, OR RENTAL ACTIVITY.

ARTICLE V: HOMEOWNER RESPONSIBILITIES

Section 5.01 Property Condition and Compliance

  • Maintain the Property in safe, habitable condition
  • Ensure systems are operational
  • Obtain required permits and licenses
  • Comply with all applicable laws and regulations
  • Maintain appropriate insurance

Section 5.02 Listing Accuracy

Homeowner is solely responsible for the accuracy and completeness of all listing Content.

Section 5.03 Renter Screening


HOMEOWNER IS SOLELY RESPONSIBLE FOR SCREENING AND APPROVING ALL THIRD-PARTY RENTERS.

ARTICLE VI: COMPENSATION

Section 6.01 Registration Fee

A non-refundable registration fee of $30.00 is required.

Section 6.02 Commission

SHB shall receive a total commission of ten percent (10%) of all Rental Income.

ARTICLE VII: DISCLAIMER OF WARRANTIES


THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND.
HOMEOWNER’S USE OF THE PLATFORM IS AT HOMEOWNER’S SOLE RISK.

ARTICLE VIII: INDEMNIFICATION AND LIMITATION OF LIABILITY


HOMEOWNER AGREES TO RELEASE, DEFEND, INDEMNIFY, AND HOLD HARMLESS THE SHB PARTIES
FROM ANY AND ALL LOSS ARISING FROM THE PROPERTY OR RENTAL ACTIVITIES.

ARTICLE IX: INSURANCE

Homeowner must maintain property and liability insurance, including coverage for short-term rental activity.

ARTICLE X: CONTENT AND INTELLECTUAL PROPERTY

Homeowner grants SHB a worldwide, royalty-free license to use provided Content for Platform operations and marketing.

ARTICLE XI: DISPUTE RESOLUTION AND ARBITRATION

This Agreement is governed by Georgia law. Disputes shall be resolved by binding arbitration in Fayette County, Georgia.

ARTICLE XII: GENERAL PROVISIONS

This Agreement constitutes the entire agreement between the parties and may be amended by SHB through Platform posting.

ACKNOWLEDGMENTS


BY SIGNING, HOMEOWNER ACKNOWLEDGES HAVING READ, UNDERSTOOD, AND AGREED TO ALL TERMS,
INCLUDING WAIVERS OF JURY TRIAL AND CLASS ACTION PARTICIPATION.
